Terms of Service

By booking a tour or purchasing products from Leadville by Lamplight Tours, you agree to the following Terms of Service. Please read them carefully.

1. Bookings & Payments

All bookings must be made in advance through our approved booking platform. Full payment is required at the time of booking to secure your reservation.

2. All Sales Final

All tour tickets are non-refundable. Missed tours, late arrivals, or changes in personal plans will not be refunded.

All book and merchandise purchases are final and are not eligible for return or refund, except in cases of damaged or incorrect items.

3. Arrival & Participation

Guests are required to arrive 5–10 minutes prior to the scheduled start time. Tours begin promptly at the scheduled time.

Participation in tours requires the ability to walk for extended periods on uneven terrain. By booking, you confirm that you are physically able to participate.

4. Weather Policy

Tours operate rain or shine. Guests are responsible for dressing appropriately for weather conditions.

In the event of severe weather or unsafe conditions, we reserve the right to cancel or modify a tour. If this occurs, guests will be offered the option to reschedule or receive a refund.

5. Assumption of Risk

By participating in a tour, you acknowledge that:

  • The tour takes place outdoors and involves walking on uneven terrain
  • Conditions may include low lighting, changing weather, and natural hazards
  • There is an inherent risk of injury associated with walking tours

You voluntarily assume all risks associated with participation.

6. Limitation of Liability

To the fullest extent permitted by law, Leadville by Lamplight Tours shall not be liable for:

  • Personal injury, loss, or damage to property
  • Delays, interruptions, or changes to the tour experience
  • Any indirect, incidental, or consequential damages

Participation is at your own risk.

7. Guest Conduct

We reserve the right to refuse service or remove any guest from a tour without refund if they:

  • Are disruptive, intoxicated, or behaving in a way that affects others
  • Fail to follow guide instructions
  • Engage in unsafe or disrespectful behavior

8. Photography & Media

By participating in our tours, you grant Leadville by Lamplight Tours permission to use photos or videos taken during the experience for marketing and promotional purposes, without compensation.

9. Intellectual Property

All content, including tour materials, written works, and books sold by Leadville by Lamplight Tours, are protected by copyright and may not be reproduced or distributed without permission.

10. Changes to Tours

We reserve the right to modify tour routes, locations, or content at any time due to weather, safety concerns, or other unforeseen circumstances.

11. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Colorado.
